What Is My Car Wreck Case Actually Worth?

Georgia has no calculator for injury claims. Here is what actually moves the number, and why the adjuster's first offer is not it.

Every week somebody asks me what their case is worth, and every week I give the same unsatisfying answer: it depends, and anyone who gives you a number in the first phone call is guessing. What I can do is tell you what the number is built out of, so you can tell whether an offer is serious.

There is no formula, whatever you read online

You will find websites that promise to multiply your medical bills by three. Insurance companies do not use that math, juries do not use that math, and neither do I. Georgia law lets an injured person recover two broad categories of loss, and only one of them has a receipt attached.

Special damages — the part with receipts

These are the losses you can add up: emergency treatment, imaging, follow-up care, physical therapy, prescriptions, the wages you did not earn while you were healing, and the cost of care you will still need next year. This is the floor of a case, not the value of one.

General damages — the part that decides the case

Pain. Sleep you do not get. The hobby you gave up. The parent who cannot lift their own child any more. Georgia does not cap these in an ordinary negligence case, and they are usually the larger half of a serious claim — but they are also the half an adjuster will tell you cannot be proven.

What actually moves the number

  • Liability clarity. A rear-end collision with a police report is a different case from a disputed left turn with no witnesses.
  • The size of the policy. A catastrophic injury against a minimum-limits driver is constrained by what is available to collect, which is why underinsured motorist coverage matters so much.
  • The treatment record. Gaps in care are the single most common thing used to argue that someone was not really hurt.
  • How you come across. If the case is tried, a jury is deciding whether to believe you.

The first offer is not an evaluation of your case. It is a test of whether you know what your case is worth.

The gap you should watch for

Adjusters make early offers because early offers are cheap. Before you have finished treating, nobody — including your own doctor — knows whether you are looking at eight weeks of therapy or a surgery. An offer made in that window is priced against the best outcome for the insurer, and signing the release closes the file permanently.

What to do this week

Keep every bill. Photograph everything, including yourself. Go to your appointments even when you feel like you are getting better. And before you give a recorded statement to the other driver’s insurer, talk to somebody whose job is not to reduce your claim — read our car wreck page or just call the office.
