Fulton and DeKalb counties

The Nagel Law Firm represents injury victims throughout Atlanta and Fulton County. Atlanta is also two counties, which matters more than most people expect.

Atlanta is the county seat of Fulton County and extends into DeKalb County. A wreck inside the city limits can therefore sit in either county before anyone has asked the venue question — and the venue question is separate again, because for a Georgia-resident defendant the county is set by where that defendant lives rather than by where the collision happened (Ga. Const. Art. VI, Sec. II, Para. VI). Where more than one at-fault party is involved and they live in different counties, O.C.G.A. § 9-10-31(b) permits the case in any county where one of them resides.

In a city with an international airport on one edge and freight on every interstate around it, the exceptions come up constantly: out-of-state drivers and motor carriers each have a venue statute of their own, and either can place the case in the county where the wreck happened. Two overlapping layers, then, both settled at the start of a case rather than the end of one.

The roads that carry the region

The Downtown Connector is the roughly 7.4-mile stretch where I-75 and I-85 run concurrently through the core, ten through lanes wide. I-20 crosses east to west. I-285 — the Perimeter — runs 63.98 miles through Fulton, Cobb, DeKalb and Clayton counties, and heavy trucks passing through rather than into Atlanta are required to bypass on it.

That last rule is not trivia. When a tractor-trailer is involved in a collision inside the Connector, why that vehicle was on that road — through traffic, or a destination in the city — is a question worth asking, and it is answered from the carrier’s own dispatch and routing records rather than from the crash report.

Where serious injury cases are heard

The Superior Court of Fulton County is part of the Atlanta Judicial Circuit and is a court of general jurisdiction, with exclusive jurisdiction over felony jury trials, divorce, equity and title to land. The State Court of Fulton County is a county-level court hearing misdemeanours including traffic, plus civil actions outside that exclusive list; it describes itself as trying serious personal injury cases. Both sit in the Justice Center Tower in downtown Atlanta.

Either can hear an auto negligence case, and ordinary injury suits are commonly filed in State Court where one exists. Which of them your case lands in is a decision, not an accident.

Trauma care, and an airport on the southern edge

Grady Memorial Hospital’s Marcus Trauma Center is a Level I trauma center, state-designated since 1987 and verified by the American College of Surgeons. Grady describes it as metro Atlanta’s only ACS-verified Level I trauma center; that is Grady’s characterisation, and we pass it on as theirs rather than asserting it ourselves.

Hartsfield-Jackson, on the southern edge of the city, was the world’s busiest airport by passenger traffic, with 106.3 million passengers in 2025. Between those two facts sits the range of an Atlanta injury practice: a Level I trauma center, and an enormous daily volume of people arriving from somewhere else.

Georgia law changes. Statutes are amended and courts reinterpret them, so anything stated as law on this page — including any statute cited — may already be out of date. Check the current law, and how it applies to your own facts, before you rely on it.
