Hit by an Uninsured Driver in Atlanta: What Now?

What happens to your injury claim when the driver who hit you has no insurance, and why your own policy matters.

You did everything right. You were driving carefully, someone else caused the wreck, and now you are hurt, missing work, and staring at medical bills. Then the officer or the other driver tells you the thing nobody wants to hear: they do not have insurance.

It is a gut punch. But it does not automatically mean you are out of options. What happens next depends almost entirely on one line buried in your own auto policy.

The Coverage That Saves These Cases

When the at-fault driver has no insurance, the first thing we look for is whether you have what is called uninsured motorist coverage. This is coverage you carry on your own policy, and it exists for exactly this situation: someone hits you, they are at fault, and they have no insurance to pay for the harm they caused.

If you have it, your own insurance company steps into the shoes of the driver who hit you. You still have to prove the other driver was at fault and prove the extent of your injuries, but there is a source of recovery. That is the difference between a case that can move forward and one that cannot.

The First Question We Ask

When a client comes to us after being hit by an uninsured driver, the very first question is simple: do you have uninsured motorist coverage?

Most people genuinely do not know. Insurance paperwork is dense, it arrives in the mail once a year, and almost nobody reads the declarations page line by line. That is normal, and it is not something to feel bad about.

So we do not just take a guess. We ask you to pull your paperwork and we look at it together. Your declarations page, your policy documents, whatever you have. The answer is in there, and it is worth finding out for certain before you assume anything about your case.

What to Gather Before You Call a Lawyer

If you have been hit by someone with no insurance, put your hands on your own insurance documents. That means:

  • Your declarations page, which lists your coverages line by line
  • Your full policy booklet if you have it
  • Your insurance card and the name of your agent
  • Any renewal notices you have received

If you cannot find any of it, your agent or your insurer’s customer service line can send you a copy. This is not a difficult request and you are entitled to it. Do this early, because the answer shapes everything that follows.

If You Have the Coverage

If your policy includes uninsured motorist coverage, we can help you. The claim proceeds against your own insurer rather than the other driver’s, but that does not mean it will be handed to you. Your insurance company is still an insurance company. They will still evaluate the claim, question the injuries, and look for reasons to pay less.

That is why it helps to have someone building the file properly from the start: documenting the other driver’s fault, keeping medical treatment consistent and recorded, and preserving the evidence that shows what this wreck actually cost you.

If You Do Not Have the Coverage

This is the hard part, and we would rather tell you the truth than string you along. If the at-fault driver has no insurance and you do not have uninsured motorist coverage, unfortunately we cannot help you. There is no policy to pay the claim.

We understand how unfair that feels. You were not the one who broke the rules, and yet you are the one carrying the loss.

The Lesson for Everyone Still Driving

If you take one thing from this, take it before you ever need it: check your policy today and find out whether you carry uninsured motorist coverage. Not after a wreck. Today, while you still have the ability to add it.

You cannot control whether the driver in the next lane bought insurance. You can control whether you are protected when they did not.

If you have been injured in a wreck in Atlanta and you are not sure what coverage applies, bring your paperwork and let us take a look. Knowing the answer costs you nothing.
