What to Expect From Your Lawyer After a Car Wreck

If this is your first car wreck, here's what a good Atlanta attorney should explain and how the process is supposed to feel.

You have never done this before. Somebody hit you, your car is sitting in a lot somewhere, your body hurts, and now you are supposed to hire a lawyer and hand your problem to a stranger who does this every day. That imbalance is real, and it matters. The wreck is one of many files on your attorney’s desk. It is the only wreck you have ever been in.

A good lawyer never forgets that difference. Here is what you should expect from the relationship, and what you should look for when you are deciding who to call.

Lawyers Exist Because Something Went Wrong

Most of the time, a lawyer only exists because there is a problem. There are transactional lawyers who are not operating in an adversarial system, but if you are doing criminal law, family law, or injury law, something happened first. Everything an attorney does in those areas is reactive to an event that already occurred.

That is worth understanding at the outset, because it explains a lot about how a case unfolds. Your lawyer cannot undo the collision. They cannot unring the bell. What they can do is take the situation as it exists and work it forward. Setting your expectations around that reality early makes the whole process easier to sit with.

You Should Be Educated on the Front End

The single biggest source of frustration in an injury claim is not knowing what is coming. A lawyer who has handled hundreds of these cases has seen the delays, the paperwork snags, and the property damage headaches a billion times over. You have never seen any of it.

That is exactly why the education needs to happen at the beginning. Before you are in the middle of it, your attorney should be walking you through the potential issues you are going to face. Property damage is a common one. It could take a week or two to get sorted out. Knowing that in advance turns a crisis into an inconvenience.

If your lawyer is not doing that, ask. Ask what the next thirty days look like. Ask what could slow things down. Ask what you are expected to do and what they will handle. Those questions are fair, and they should be welcomed rather than brushed off.

Ask Your Questions Without Apologizing

Clients often hesitate to call or email because they assume the question is too small or too obvious. It is not. The fact that a firm has seen an issue a thousand times does not mean you have. That is the entire reason you hired someone.

A firm that keeps perspective will treat your fifth question the same as your first. The volume of cases on the other side of the desk should never translate into impatience with the person living through one.

Your Lawyer Is Also a Counselor

Another name for an attorney is counselor. That is really what the job is. Sometimes the most valuable thing a lawyer does in a given week is hear a client out.

Some parts of a wreck are simply bad and cannot be fixed. Your car that you just paid off, the one with no car payment left on it, gets totaled. That sucks. There is nothing your lawyer can do about that, and you are not going to get your money back either. Pretending otherwise would be dishonest.

What a good attorney can do is tell you the truth about that plainly, sit with you in the frustration for a minute, and then get back to work on the parts of the case that can actually be moved. Honesty about the limits is a feature, not a failure.

What This Means for Choosing a Firm

When you are interviewing lawyers after a collision in Atlanta, listen for two things. First, do they explain the road ahead before you have to ask? Second, when you raise something that has no good answer, do they level with you or talk around it?

Experience matters, but experience without perspective produces a firm that treats you like a file number. You want both: someone who has seen this a thousand times and still remembers that you have not.

Being a lawyer in general, we only exist if there’s a problem, most of the time. There may be transactional lawyers and things like that that aren’t in an adversarial system, but if you’re doing criminal law, family law, like something happened. And so we are all reactive to whatever happened.

Keeping that perspective, like, yes, this is one of many clients that we are fortunate enough to be assisting, but to them, this is the only car wreck they’ve been in. You know, for us, it’s one of many that we’ve either handled or are currently handling. But for them, it’s like, this is the only thing that’s happened.

I try to keep that in perspective when clients call or email and have questions because, oh, I’ve seen this a billion times. They’ve never seen it. So I do my best to kind of educate them on the front end. These are potential issues that we are going to have, such as property damage. It could take a week or two.

Sometimes it’s hard because another name for an attorney is a counselor. That’s really like what we are. Like sometimes we have to be the counselor for our clients and just hear them out. Your car that you just paid off with no car payment, get totaled, sucks. There’s nothing I can do about that. And you’re not going to get your money back. Neither.
